Warranty conditions

In addition to the statutory warranty rights granted to you as a consumer, we, Wentronic GmbH, grant a limited manufacturer’s warranty for a selection of our Goobay® products for perfect condition and function under the following conditions:

For the purposes of this manufacturer’s warranty, a “consumer” is any natural person who is the owner of a Goobay® product and has not purchased it in order to resell it or to install it for third parties as part of their commercial, independent professional activity.

1. guarantee period and assertion of the guarantee
The guarantee period applies from the date of your purchase of the Goobay® product as follows:

To assert the warranty, please contact us using the options listed below.
Our competent staff will take up your problem and coordinate the next steps with you.
In the event of a return, please use the original packaging if possible to avoid transport damage.

Proof of purchase (receipt/invoice) is required to claim under the guarantee.
Please keep this as proof of purchase.

2 Territorial scope of the guarantee

The warranty applies to our Goobay® products in the following countries:
EU, UK and Switzerland

3. nature and scope of the guarantee

The type of warranty service is provided at our discretion by repairing or replacing the affected Goobay® product free of charge (if the product is unavailable, e.g. due to a product change, we will supply an equivalent replacement that looks as similar as possible. Furthermore, we reserve the right to adapt the warranty service to technical progress).

The scope of the warranty does not cover defects and damage due to improper use, wearing parts and consumables.
Improper use includes in particular:
– use that deviates from the specifications in the operating/user manual (if no operating/user manual is available, any use that is not
intended or unusual is considered improper use),
– failure to observe the safety instructions in the operating/user manual or on the packaging,
– water, drop and fall damage as well as damage caused by soiling
– technical interventions carried out by yourself or by third parties, e.g. disassembly, modification or alteration, – improper storage – improper assembly, disassembly, modification or alteration, – improper use of the product, e.g.disassembly, modification or alteration,
– improper storage
– improper assembly
– normal wear and tear (e.g. scratches) and changes to the surface/color caused by use

The guarantee also does not apply to display items or B-goods

If Wentronic establishes upon inspection of the Goobay® product that the fault/defect does not justify the assertion of warranty claims, Wentronic reserves the right to charge the consumer for any costs of the inspection.
Transportation costs and risks are not covered by Wentronic.

Damage that has not occurred to the Goobay® product itself is also not covered by the guarantee.
Claims for damages of any kind, in particular for breach of duty and tort, as well as claims for reimbursement of futile expenses against us and against our vicarious agents are therefore excluded under the guarantee; this also applies to claims for compensation for consequential damages. No further claims arise under the guarantee.

The above limitations do not apply to statutory rights to which the end customer (consumer) is entitled under a consumer goods purchase or generally to the buyer arising from injury to life, limb or health or due to intent or gross negligence or under the German Product Liability Act (ProdHaftG).

A service based on the guarantee does not extend the guarantee period, nor does it initiate a new guarantee.

4. expiry of the guarantee

After the warranty period has expired, you also have the option of contacting our service hotline.
However, any repairs required after the warranty period has expired are subject to a charge and are not included in the scope of the warranty.

5. no exclusion of statutory warranty rights / information in the case of guarantee promises (§ 477 BGB):

The statutory warranty rights are not restricted by this guarantee, but remain fully available to the purchaser.

Irrespective of this manufacturer’s warranty and regardless of whether or not the prescribed warranty is claimed in the event of a warranty claim, the statutory warranty rights against the seller apply without restriction. In addition to or even without asserting the warranty claims, the legally regulated buyer rights due to defects in the purchased item – in particular subsequent performance, withdrawal, reduction of the purchase price or damages (see § 437 BGB and the corresponding special limitation regulations in § 438 BGB) – can therefore be asserted against the seller at the seller’s own discretion.

6. consumer information on out-of-court online dispute resolution and the consumer arbitration board

If and insofar as manufacturer’s warranty contracts arise between us, Wentronic GmbH, and consumers, we are obliged to provide the following information:

– The European Commission provides a platform for out-of-court online dispute resolution (so-called ODR platform), which you can find at https://ec.europa.eu/consumers/odr.

– In the area of manufacturer’s warranty contracts, we are obliged and willing to participate in a dispute resolution procedure before a consumer arbitration board. We hereby designate the consumer arbitration board responsible for us as follows:

In the event of a warranty claim, please contact the customer service department specified here. A precise description of the fault makes our technicians’ work easier and shortens the repair time. Detach this card, fill it in legibly and send it to the following service address together with the defective device and the original proof of purchase:

*On March 2, 2017, the ECJ (case no. 568/15) issued a ruling on the interpretation of the term “basic rate” and determined that the costs of a call to a service number set up by a trader in relation to a consumer contract may not exceed the costs of a call to a normal geographical landline number or a mobile number. Following reassurance from our service provider, all our contracts have been checked for this regulation and comply with the legal requirements. If you expect to be charged higher costs, we would ask you to contact us. We will of course reimburse you for any additional costs.
